Dear Ms. Marsh:
This refers to your citizen petition dated, May 7, 1999, and filed on May 11, 1999, under
docket number 99P-1340/CP 1, requesting that appropriate warning statements be placed on
the labeling of Calvin Klein's "Eternity" fragrance products because such
products contain toxic fragrance components.
The purpose of this response is to advise you, in accordance with 21 CFR [section symbol]
10.30(e)(2), that we have not been able to reach a decision on your petition within the
first 180 days of its receipt because of other Agency priorities and the limited
availability of resources.
We will contact you again when our review of the petition has been completed, at which
time we will inform you of the actions, if any, the Agency feels are appropriate in
response to your petition. In the interim, you and other interested parties may continue
to submit additional supplemental materials for Agency consideration to the Docket Number
referenced above.
Sincerely yours,
